Every photorgaph on this and every other Dmitry Argunov Photography web site is protected by Russian Federal, US Federal and International copyright laws. The fact they are published on the Internet does not mean they are public domain. These images are available for licensing as traditional rights protected (including editorial) stock photography and they are the intellectual property of Dmitry Argunov.

You may not download any images without licensing. If you wish to obtain permission from Dmitry Argunov to use any image on this web site, please license it through a service of this site (please see details above). Thanks you.

WARNING: I vigorously protect my copyright interests. In the event that an infridgement is discovered you will be notified and invoiced the industry-standard TRIPLE FEE unauthorized usage and/or prosecuted for Copyright Infringement in Russia Federation Arbitration Court, US Federal Court or other applicable international court where you will be subject to a liability of up to US$100.000 statutory damages as well as my court costs and attorney's fees.

I suppose that you carefully read the text above and familiarized yourself with all terms and conditions of ordering prints and licensing images published at this website. These terms and conditions together with prints price, licensing fees amounts and image descriptions published at this website constitute a binding offer and are treated as an agreement valid from the legal point of view. Upon ordering a print or licensing an image from this web-site you unconditionally agree on these terms and conditions and accept this binding offer.

Licensing and Prints order

I offer two facilities for potential buyers:
- order prints of images located at Dmitry Argunov Photography (c) web-site (further "Image(-s)" or "Photo(-s)" or "Photograph(-s)");
- license image through digital downloads

Simply use "Add to Cart" option from "Actions" opening menu located under photograph thumbnails or select suitable price option at a photograph page. You can add to the cart an unlimited number of products either digital downloads or prints. Also You can order digital downloads of different resolution and / or prints with different sizes of a one photograph in the same order.

All orders will be fulfilled once payment is recieved. Please note that I accept payments through MoneBookers (www.moneybookers.com) only (the Payment system).

For your convenience there are options of "Add to Favorities" to create a collection of photographs you like and "Send eCard" to send a link to a selected photograph / album to an e-mail address at your choice.

Prints

Please note that print sizes may differ from image to image (but always meet wide size specified in your order) to better fit an image actual proportions and composition. You can also contact me if you need a larger print size and I will do my best to meet your requirements at reasonable price. I will fulfill you order and ship prints to the address you specified within 48 to 72 hours after the payment is cleared by the Payment system.

Licensing images through Digital downloads

1. Photos on the site are priced based on single-use license. If you would like to get multiple-use license please contact me directly for respective price (usually 20-30% higher depending on intended use).
2. Through licensing of an image you do not purchase copyright of the image. You get the right to publish photo. The right is non-exclusive unless I make photos for you under the assignment or you make other arrangements with me (please contact me directly to discuss).
3. Images become available for download after the payment is done and cleared by the Payment system.
4. Standard set of available downloads include small resolution image for web-usage, 1280 pixel wide print-ready image and full resolution image (please read the first point above). The full resolution may differ from image to image depending on the resolution of camera, scanner (for scanned films) and / or applied crop.
5. In general you are responsible for liability of use. I can not warrant whether your final use of an image requires additional permissions. It is your sole responsibility to assure that the photo you are licensing is suitable for your intended use. Please also read special note on sport events photos available for licensing through this site.

Licensing of sport events photos

In addition to the conditions mentioned above the following terms are applicable to ALL sport events photos available for licensing through this site:
1. I supply EDITORIAL reproduction rights only for such photos.
2. Photos of organized sport may not be used for commercial, advertising or promotional purposes without the consent of organization, athletes, their agents and/or parents (if and where applicable) and me.
3. If you are using such photos commercially, it is your responsibility to secure permissions with athletes and companies (logos) involved. I do not sell commercial rights on sport events images.

Privacy Policy

This privacy statement discloses the privacy practices for http://www.dmitryargunov.com and http://www.dmitryargunovphotography.com.

Information Collection and Use

I am the sole owner of the information collected on www.dmitryargunov.com and www.dmitryargunovphotography.com web-sites (further "Web-Sites"). I will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. The information is collected from users of the Web-Sites at several different points.

Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on the Web-Sites. Once the user closes their browser, the cookie simply terminates. For instance, by setting a cookie on the Web-Sites, the user would not have to log in a password more than once, thereby saving time while on the Web-Sites. If a user rejects the cookie, they may still use the Web-Sites. Some of our business partners use cookies on the Web-Sites (for example, advertisers). However, I have no access to or control over these cookies.

Log Files

I use IP addresses to analyze trends, administer the Web-Sites, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Links

The Web-Sites contain links to other sites. Please be aware that I am not responsible for the privacy practices of such other sites. I encourage users of the Web-Sites to be aware when they leave the Web-sites and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by the Web-sites.

Third Parties on the Web-Sites

The Web-Sites may contain advertisements, references and links to other web sites and organizations. You should be aware that different rules may apply to the collection, use or disclosure of your information by third parties in connection with their advertisements, promotions and other web sites you encounter on the Internet. The use of such technology by these third parties is within their control and not mine, and even if I have a relationship with the third party, I do not control those sites or their policies and practices regarding your information and I encourage you to investigate and ask questions directly of them in this regard.

Except as described in this Privacy Statement, I use good faith efforts not to provide third parties with access to your personally identifiable information. I will, however, make your personally identifiable information available to others:
- When I have your consent (you "opt in") to do so, in which case their use of your information is subject to their own privacy policies;
- When I have retained companies to work with or on my behalf to fulfill print orders that you have requested;
- When I am compelled to do so by a governmental agency, court or other entity (e.g., to respond to subpoenas, court orders or legal process);
- If I believe your actions violate any law, regulation, Terms and Policies of the Web-Sites or any other features or functions of the Web-Sites, or if you threaten my rights, property or safety or the rights, property or safety of advertisers, other customers or users, or any other party;
- As and when I, in my sole discretion, believe such disclosure to be necessary or appropriate to investigate or resolve possible problems or inquiries, to protect my business and assets, to defend my interests and/or to comply with my legal and regulatory obligations; or
- In the event of a bankruptcy, or a merger, acquisition, joint venture or other business combination involving me.

It is also possible that third parties may unlawfully intercept or access transmissions or private communications.

I do not sell or market your personally identifiable information to unaffiliated organizations.

Some of the aggregate customer data I collect may be shared with advertising companies in order to enhance and improve the operation and relevance of the Web-Sites, but I do not give any personally identifiable information to them as part of this relationship. Use of their tracking technology is subject to their own privacy policies.

Communications from me and the Web-Sites

If you provide me with your e-mail address, I may occasionally send you emails notifying you about new services, products or other news relevant for you or the community.

E-Mail Card

If a user elects to send a photo to a friend, I ask them for the friend’s name and email address. The Web-Sites will automatically send the friend respective one-time email. The Web-Sites store this information for the sole purpose of sending this one-time email. The friend may contact me at http://www.www.dmitryargunov.com or directly at dmitryargunovphotography@gmail.com to request the removal of this information from the Web-Sites database.

Security

The Web-Sites take every precaution to protect users’ information. When users submit sensitive information via the Web-Sites, your information is protected both online and off-line.

If you have any questions about the security at the Web-Sites, you can send an email to either webmaster@dmitryargunov.com or webmaster@dmitryargunovphotography.com.

Correction/Updating Personal Information:

If a user’s personally identifiable information changes (such as your zip code), or if a user no longer desires my service, I will endeavor to provide a way to correct, update or remove that user’s personal data provided to me. This can usually be done by emailing our Customer Support at dmitryargunovphotography@gmail.com.

Notification of Changes

If I decide to change privacy policy of the Web-Sites, I will post those changes on this page so users are always aware of what information I collect, how I use it, and under what circumstances, if any, I disclose it. If at any point I decide to use personally identifiable information in a manner different from that stated at the time it was collected, I will notify users by way of an email. Users will have a choice as to whether or not I use their information in this different manner. I will use information in accordance with the privacy policy under which the information was collected.

Return and Refund Policy

Your satisfaction is my primary concern! Explained below is my refund policy for the different products that I offer. Should you have any questions regarding refunds, please direct them to me through Contact Me form ar by email at dmitryargunovphotography@gmail.com.

Digital Downloads

You may ask for a refund of your purchase within 7 days from the purchase date. Note that this is possible only if you are able to immediately remove all images used in different designs and that you must provide a well founded reason for your request, number of your order and your registration details (name, full address, phone number and e-mail address) at www.dmitryargunovphotography.com.

If you have downloaded an image that has technical flaws please first of all try to download it again. Please note that according to my standard license you allowed to download ordered images 5 times. If the flaw is still there then please contact me for a refund and send me:
- a ZIP archiev with a NON-altered digital file of the image,
- description of flaws, and
- a reference 'Refunds' [ Number of your order at www.dmitryargunovphotography.com ] (you may find this number in an email with your order confirmation you received from me).
In case of the flaws your described exist in the NON-ALTERED image I will issue a full refund for you. If you are not able to download an image, I will refund you as well, provided that I determine that you have been unable to download the image successfully. Downloads are not refunded if more than 7 days from the download date have passed.

Fina-Art Prints

I am dedicated to delivering high-quality photographic prints from your digital pictures, and use high-quality professional labs for prints fulfillment only.

If for any reason you are not satisfied with any prints that you purchase, please contact us within 30 days for one free set of reprints or your money back.

To get a refund, simply return the prints that you want a refund for to the following address:
